Terms and Conditions: 30 Day Winterm Evaluation Offer
This Agreement sets forth the terms and conditions of your use of Wyse® Winterm™ unit (Product) for a 30-day evaluation.
"No risk evaluation" of your Winterm unit begins 30 days after you receive your Winterm from Wyse Technology Inc.
Unless otherwise specified, you must provide your own monitor. Keyboard and mouse are included with the unit.
To receive the Winterm unit, Wyse will charge the unit to your credit card upon shipment. Discounted promotional pricing is listed on the order form. Sales tax is applicable in Arizona, California, Colorado, Florida, Georgia, Illinois, Kansas, Maryland, Massachusetts, Michigan, Minnesota, New Jersey, New York, Ohio, Pennsylvania, Tennessee, Texas, Virginia, and Washington. If you are tax exempt, a copy of your tax exemption certificate should be faxed to (408) 473-2080.
Wyse will send the product to the requestor at Wyse's expense. Orders placed by 12 noon PST, will be shipped the same day. Please allow 3 business days for delivery. Faster delivery at requestor's expense may be arranged by calling us toll free in the U.S. or Canada at (800) 438-9973, option 1, or directly at (408) 473-1200.
During the testing period, you are liable for any damage to the Winterm unit.
The provisions of the software license, which is included in the documentation provided with the Winterm evaluation unit, apply to your usage of the product.
If you choose not to keep your Winterm, simply return it to Wyse Technology by calling toll free in the U.S. or Canada (800) 438-9973, option 1, to obtain an RMA number from your Inside Sales Representative. Wyse will fax back the RMA number along with instructions on where to return the unit. Your credit card will be credited the full amount upon return of the unit. To ensure proper credit, an RMA number is required before returning the product. To qualify for a refund, products must be received by Wyse within 45 days of initial receipt of product.
Orders following the purchase of your evaluation unit can only be made via an Authorized Wyse Partner.
Limitation of Liability: NEITHER PARTY SHALL BE LIABLE TO THE OTHER FOR ANY INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF THIS AGREEMENT OR THE RELATIONSHIP BETWEEN WYSE AND EVALUATOR, INCLUDING WITHOUT LIMITATION, LOSS OF PROFIT.
The laws of the State of California govern this Agreement.
